
Regarding the Supreme Court ruling in its lawsuit with Nexon, Ironmace released an official statement on the 30th emphasizing that the originality of 'Dark and Darker' has been recognized. The company also stated that it would continue to prove its innocence in the ongoing criminal trial regarding the trade secret infringement charges on which it partially lost.
Ironmace views the confirmation of non-infringement of copyright as the core achievement of this Supreme Court ruling. The company stated, "With this ruling, the Supreme Court has clarified that Nexon's 'P3' game and 'Dark and Darker' are not similar, and that Ironmace did not unfairly use Nexon's achievements."
On the other hand, the company expressed deep regret over the trade secret infringement ruling, which resulted in a ₩5.7 billion damage award, and pointed to a discrepancy between the civil judgment and the criminal case. Ironmace argues that while the prosecution concluded there was no evidence of trade secret theft by the company or its employees based on expert appraisals, it was unable to sufficiently clarify these points during the civil litigation process due to procedural limitations.
"Under criminal procedure law, we were unable to verify such objective data until the appellate court ruling was delivered," Ironmace emphasized. "We intend to prove our innocence to the end in the ongoing criminal trial regarding the allegations that we transferred Nexon's data for illicit purposes."
Despite the confirmed liability for some trade secret infringements, the company plans to continue game services without disruption, having cleared the core risk of the copyright dispute. While expressing regret over parts of the ruling, Ironmace stated it is pleased to be able to provide stable service for the game moving forward, and expressed its commitment to proving itself through the game to avoid disappointing its users.
